Hague Apostille vs. Consular Legalisation: Key Differences

Typically, a document is only valid within the territory of the country where it was issued. To be used internationally, it must undergo an authentication process to prove it was issued by a competent authority in compliance with local laws. This authentication occurs via two distinct methods: the Hague Apostille or Consular Legalisation.

The Hague Apostille

The Apostille is the simplified procedure adopted by countries signatory to the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents, commonly known as the Hague Convention.

  • Process: The authentication is performed by a designated authority in the document’s country of origin.

  • Validity: Once apostilled, the document is automatically recognised in all other member countries (including Brazil).

  • Identification: An Apostille is easily identified by its French title: “Apostille – Convention de La Haye du 5 octobre 1961”. It may be attached to the original document or issued as a separate sheet.

Consular Legalisation

If either the country of origin or the destination country is not a signatory to the Hague Convention, the document must undergo the traditional legalisation process.

  • Process: This involves multi-step authentication, culminating in legalisation at the Embassy or Consulate of the destination country.

  • Variability: Unlike the standardised Apostille, each diplomatic mission has its own specific procedures, fees, and processing times.
